style=\"color: #000000;\">Des \u00e9cussons tiss\u00e9s ou imprim\u00e9s.<\/span><\/li>\n<li><span style=\"color: #000000;\">Des cr\u00e9ations \u00e0 partir de fichiers clients.<\/span><\/li>\n<li><span style=\"color: #000000;\">Des v\u00eatements et accessoires textiles personnalis\u00e9s.<\/span><\/li>\n<li><span style=\"color: #000000;\">Des fabrications en petites ou grandes s\u00e9ries.<\/span><\/li>\n<\/ul>\n<p><span style=\"color: #000000;\">Les dimensions, mat\u00e9riaux, finitions, quantit\u00e9s et<\/span><br \/><span style=\"color: #000000;\">caract\u00e9ristiques essentielles sont pr\u00e9cis\u00e9s dans les<\/span><br \/><span style=\"color: #000000;\">fiches produits ou les devis accept\u00e9s.<\/span><\/p>\n<p><span style=\"color: #000000;\">La faisabilit\u00e9 de chaque personnalisation d\u00e9pend<\/span><br \/><span style=\"color: #000000;\">des contraintes techniques de fabrication.<\/span><\/p>\n<h2><span style=\"color: #000000;\">Article 4 \u2013 Fabrication et sous-traitance<\/span><\/h2>\n<p><span style=\"color: #000000;\">DIPatch peut assurer directement la fabrication<\/span><br \/><span style=\"color: #000000;\">ou faire appel \u00e0 des ateliers partenaires situ\u00e9s<\/span><br \/><span style=\"color: #000000;\">en France ou \u00e0 l&rsquo;\u00e9tranger.<\/span><\/p>\n<p><span style=\"color: #000000;\">Le choix du proc\u00e9d\u00e9 de fabrication d\u00e9pend notamment<\/span><br \/><span style=\"color: #000000;\">des quantit\u00e9s, des mat\u00e9riaux, des caract\u00e9ristiques<\/span><br \/><span style=\"color: #000000;\">techniques et des d\u00e9lais convenus.<\/span><\/p>\n<p><span style=\"color: #000000;\">Le recours \u00e0 un partenaire ne lib\u00e8re pas DIPatch<\/span><br \/><span style=\"color: #000000;\">de ses obligations contractuelles envers le client.<\/span><\/p>\n<p><span style=\"color: #000000;\">Une origine de fabrication sp\u00e9cifique, notamment<\/span><br \/><span style=\"color: #000000;\">fran\u00e7aise, n&rsquo;est garantie que lorsqu&rsquo;elle est<\/span><br \/><span style=\"color: #000000;\">express\u00e9ment confirm\u00e9e dans la description du produit<\/span><br \/><span style=\"color: #000000;\">ou dans le devis d\u00e9finitif.<\/span><\/p>\n<h2><span style=\"color: #000000;\">Article 5 \u2013 Personnalisation et fichiers clients<\/span><\/h2>\n<p><span style=\"color: #000000;\">Le client peut transmettre un logo, dessin,<\/span><br \/><span style=\"color: #000000;\">illustration, texte ou fichier destin\u00e9<\/span><br \/><span style=\"color: #000000;\">\u00e0 personnaliser un produit.<\/span><\/p>\n<p><span style=\"color: #000000;\">Il garantit disposer des droits n\u00e9cessaires<\/span><br \/><span style=\"color: #000000;\">\u00e0 l&rsquo;utilisation et \u00e0 la reproduction de ces \u00e9l\u00e9ments.<\/span><\/p>\n<p><span style=\"color: #000000;\">DIPatch peut refuser une cr\u00e9ation manifestement illicite,<\/span><br \/><span style=\"color: #000000;\">contrefaisante ou techniquement irr\u00e9alisable.<\/span><\/p>\n<h3><span style=\"color: #000000;\">Adaptations techniques<\/span><\/h3>\n<p><span style=\"color: #000000;\">La broderie, le tissage et l&rsquo;impression peuvent<\/span><br \/><span style=\"color: #000000;\">n\u00e9cessiter des adaptations portant notamment sur :<\/span><\/p>\n<ul>\n<li><span style=\"color: #000000;\">La finesse des traits.<\/span><\/li>\n<li><span style=\"color: #000000;\">La lisibilit\u00e9 des petites inscriptions.<\/span><\/li>\n<li><span style=\"color: #000000;\">Le nombre et les nuances de couleurs.<\/span><\/li>\n<li><span style=\"color: #000000;\">Les d\u00e9tails complexes.<\/span><\/li>\n<li><span style=\"color: #000000;\">Les proportions du visuel.<\/span><\/li>\n<\/ul>\n<p><span style=\"color: #000000;\">De l\u00e9g\u00e8res variations inh\u00e9rentes au proc\u00e9d\u00e9 utilis\u00e9<\/span><br \/><span style=\"color: #000000;\">peuvent exister, dans la limite des caract\u00e9ristiques<\/span><br \/><span style=\"color: #000000;\">contractuellement convenues.<\/span><\/p>\n<p><span style=\"color: #000000;\">Ces tol\u00e9rances ne suppriment pas les garanties<\/span><br \/><span style=\"color: #000000;\">l\u00e9gales du client.<\/span><\/p>\n<h2><span style=\"color: #000000;\">Article 6 \u2013 Estimateur de devis professionnel<\/span><\/h2>\n<p><span style=\"color: #000000;\">DIPatch met \u00e0 disposition un estimateur de prix<\/span><br \/><span style=\"color: #000000;\">dans son <a style=\"color: #000000;\" href=\"https:\/\/dipatch.fr\/en\/patchs-brodes-personnalises-pour-professionnels\/\"><br \/>Professional Space<\/a>.<\/span><\/p>\n<p><span style=\"color: #000000;\">Cet outil permet d&rsquo;obtenir une premi\u00e8re estimation<\/span><br \/><span style=\"color: #000000;\">en fonction des dimensions, des quantit\u00e9s et des<\/span><br \/><span style=\"color: #000000;\">options de personnalisation s\u00e9lectionn\u00e9es.<\/span><\/p>\n<p><span style=\"color: #000000;\"><strong>Les montants communiqu\u00e9s sont indicatifs<br \/>et non contractuels.<\/strong><\/span><\/p>\n<p><span style=\"color: #000000;\">L&rsquo;estimation ne constitue pas un devis d\u00e9finitif<\/span><br \/><span style=\"color: #000000;\">et ne garantit ni la faisabilit\u00e9, ni le prix final,<\/span><br \/><span style=\"color: #000000;\">ni le d\u00e9lai de fabrication.<\/span><\/p>\n<p><span style=\"color: #000000;\">Un devis d\u00e9finitif est \u00e9tabli apr\u00e8s \u00e9tude du projet,<\/span><br \/><span style=\"color: #000000;\">v\u00e9rification des fichiers, des conditions de fabrication<\/span><br \/><span style=\"color: #000000;\">et des \u00e9ventuels frais suppl\u00e9mentaires.<\/span><\/p>\n<p><span style=\"color: #000000;\">Le client reste libre d&rsquo;accepter ou de refuser<\/span><br \/><span style=\"color: #000000;\">le devis d\u00e9finitif.<\/span><\/p>\n<h2><span style=\"color: #000000;\">Article 7 \u2013 Commandes des particuliers<\/span><\/h2>\n<p><span style=\"color: #000000;\">Les commandes des particuliers sont r\u00e9alis\u00e9es<\/span><br \/><span style=\"color: #000000;\">directement sur DIPatch.fr, lorsque les produits<\/span><br \/><span style=\"color: #000000;\">sont disponibles \u00e0 la commande.<\/span><\/p>\n<p><span style=\"color: #000000;\">Avant paiement, le client peut v\u00e9rifier<\/span><br \/><span style=\"color: #000000;\">les caract\u00e9ristiques, les quantit\u00e9s, le prix total<\/span><br \/><span style=\"color: #000000;\">et les informations de livraison.<\/span><\/p>\n<p><span style=\"color: #000000;\">La commande est confirm\u00e9e apr\u00e8s validation<\/span><br \/><span style=\"color: #000000;\">du paiement et \u00e9mission d&rsquo;une confirmation<\/span><br \/><span style=\"color: #000000;\">par DIPatch.<\/span><\/p>\n<p><span style=\"color: #000000;\">Si une commande accept\u00e9e ne peut \u00eatre honor\u00e9e,<\/span><br \/><span style=\"color: #000000;\">DIPatch informe le client et propose, selon<\/span><br \/><span style=\"color: #000000;\">les circonstances, une solution alternative<\/span><br \/><span style=\"color: #000000;\">accept\u00e9e par celui-ci ou le remboursement d\u00fb.<\/span><\/p>\n<p><span style=\"color: #000000;\"><strong>Information temporaire :<\/strong><\/span><br \/><span style=\"color: #000000;\">la reprise des commandes particuli\u00e8res<\/span><br \/><span style=\"color: #000000;\">est annonc\u00e9e pour le 2 janvier 2027.<\/span><\/p>\n<p><span style=\"color: #000000;\">Cette information peut \u00e9voluer et n&rsquo;affecte pas<\/span><br \/><span style=\"color: #000000;\">les commandes ant\u00e9rieurement accept\u00e9es.<\/span><\/p>\n<h2><span style=\"color: #000000;\">Article 8 \u2013 Commandes professionnelles<\/span><\/h2>\n<p><span style=\"color: #000000;\">Les professionnels peuvent soumettre un projet<\/span><br \/><span style=\"color: #000000;\">depuis l&rsquo;Espace Pro, le formulaire de contact<\/span><br \/><span style=\"color: #000000;\">ou par courrier \u00e9lectronique.<\/span><\/p>\n<p><span style=\"color: #000000;\">Apr\u00e8s analyse, DIPatch transmet un devis pr\u00e9cisant<\/span><br \/><span style=\"color: #000000;\">notamment :<\/span><\/p>\n<ul>\n<li><span style=\"color: #000000;\">Les produits et quantit\u00e9s command\u00e9s.<\/span><\/li>\n<li><span style=\"color: #000000;\">Les dimensions et techniques utilis\u00e9es.<\/span><\/li>\n<li><span style=\"color: #000000;\">Les mat\u00e9riaux et finitions.<\/span><\/li>\n<li><span style=\"color: #000000;\">Le prix et les frais annexes.<\/span><\/li>\n<li><span style=\"color: #000000;\">Les modalit\u00e9s de r\u00e8glement.<\/span><\/li>\n<li><span style=\"color: #000000;\">La date ou le d\u00e9lai de livraison convenu.<\/span><\/li>\n<\/ul>\n<p><span style=\"color: #000000;\">La commande devient ferme apr\u00e8s acceptation<\/span><br \/><span style=\"color: #000000;\">\u00e9crite du devis, selon les conditions qui y figurent.<\/span><\/p>\n<p><span style=\"color: #000000;\">Sauf accord particulier, la fabrication<\/span><br \/><span style=\"color: #000000;\">ne d\u00e9bute qu&rsquo;apr\u00e8s encaissement int\u00e9gral du prix<\/span><br \/><span style=\"color: #000000;\">et validation des \u00e9l\u00e9ments techniques n\u00e9cessaires.<\/span><\/p>\n<h2><span style=\"color: #000000;\">Article 9 \u2013 Bon \u00e0 tirer et validation<\/span><\/h2>\n<p><span style=\"color: #000000;\">Pour certaines cr\u00e9ations, DIPatch peut proposer<\/span><br \/><span style=\"color: #000000;\">une maquette ou un bon \u00e0 tirer (BAT).<\/span><\/p>\n<p><span style=\"color: #000000;\">Le client v\u00e9rifie les dimensions, les textes,<\/span><br \/><span style=\"color: #000000;\">les couleurs pr\u00e9vues, les placements et les \u00e9l\u00e9ments<\/span><br \/><span style=\"color: #000000;\">repr\u00e9sent\u00e9s avant de donner son accord \u00e9crit.<\/span><\/p>\n<p><span style=\"color: #000000;\">La validation autorise la fabrication conform\u00e9ment<\/span><br \/><span style=\"color: #000000;\">aux caract\u00e9ristiques approuv\u00e9es.<\/span><\/p>\n<p><span style=\"color: #000000;\">Les couleurs affich\u00e9es sur \u00e9cran peuvent diff\u00e9rer<\/span><br \/><span style=\"color: #000000;\">l\u00e9g\u00e8rement du rendu physique.<\/span><\/p>\n<p><span style=\"color: #000000;\">La validation d&rsquo;un BAT n&rsquo;exclut pas les garanties<\/span><br \/><span style=\"color: #000000;\">l\u00e9gales applicables aux produits livr\u00e9s.<\/span><\/p>\n<h2><span style=\"color: #000000;\">Article 10 \u2013 Prix et TVA<\/span><\/h2>\n<p><span style=\"color: #000000;\">Les prix sont exprim\u00e9s en euros.<\/span><\/p>\n<p><span style=\"color: #000000;\">Pour les consommateurs, le prix total \u00e0 payer,<\/span><br \/><span style=\"color: #000000;\">incluant les taxes applicables et les frais connus,<\/span><br \/><span style=\"color: #000000;\">est communiqu\u00e9 avant la commande.<\/span><\/p>\n<p><span style=\"color: #000000;\">Pour les professionnels, les devis pr\u00e9cisent<\/span><br \/><span style=\"color: #000000;\">les montants hors taxes et, lorsque n\u00e9cessaire,<\/span><br \/><span style=\"color: #000000;\">toutes taxes comprises.<\/span><\/p>\n<p><span style=\"color: #000000;\">Lorsque le Vendeur b\u00e9n\u00e9ficie effectivement<\/span><br \/><span style=\"color: #000000;\">de la franchise en base de TVA, ses documents<\/span><br \/><span style=\"color: #000000;\">comportent la mention l\u00e9gale applicable :<\/span><br \/><span style=\"color: #000000;\">\u00ab TVA non applicable, article 293 B du CGI \u00bb.<\/span><\/p>\n<p><span style=\"color: #000000;\">Les tarifs peuvent \u00e9voluer pour les commandes<\/span><br \/><span style=\"color: #000000;\">futures, sans modification unilat\u00e9rale<\/span><br \/><span style=\"color: #000000;\">des commandes d\u00e9j\u00e0 conclues.<\/span><\/p>\n<h2><span style=\"color: #000000;\">Article 11 \u2013 Paiement<\/span><\/h2>\n<h3><span style=\"color: #000000;\">Particuliers<\/span><\/h3>\n<p><span style=\"color: #000000;\">Le paiement est exigible en totalit\u00e9<\/span><br \/><span style=\"color: #000000;\">au moment de la commande.<\/span><\/p>\n<h3><span style=\"color: #000000;\">Professionnels<\/span><\/h3>\n<p><span style=\"color: #000000;\">Sauf accord \u00e9crit contraire, les commandes<\/span><br \/><span style=\"color: #000000;\">professionnelles doivent \u00eatre r\u00e9gl\u00e9es<\/span><br \/><span style=\"color: #000000;\">int\u00e9gralement avant fabrication.<\/span><\/p>\n<p><span style=\"color: #000000;\">Le r\u00e8glement s&rsquo;effectue selon les modalit\u00e9s<\/span><br \/><span style=\"color: #000000;\">indiqu\u00e9es sur le devis ou la facture.<\/span><\/p>\n<p><span style=\"color: #000000;\">En cas de retard de paiement d&rsquo;une somme exigible<\/span><br \/><span style=\"color: #000000;\">due par un professionnel, des p\u00e9nalit\u00e9s sont applicables<\/span><br \/><span style=\"color: #000000;\">de plein droit, sans rappel pr\u00e9alable, au taux de<\/span><br \/><span style=\"color: #000000;\">refinancement de la Banque centrale europ\u00e9enne<\/span><br \/><span style=\"color: #000000;\">applicable au semestre concern\u00e9, major\u00e9<\/span><br \/><span style=\"color: #000000;\">de dix points de pourcentage.<\/span><\/p>\n<p><span style=\"color: #000000;\">Une indemnit\u00e9 forfaitaire de 40 \u20ac pour frais<\/span><br \/><span style=\"color: #000000;\">de recouvrement est \u00e9galement due conform\u00e9ment<\/span><br \/><span style=\"color: #000000;\">\u00e0 la r\u00e9glementation applicable.<\/span><\/p>\n<p><span style=\"color: #000000;\">Une indemnisation compl\u00e9mentaire peut \u00eatre demand\u00e9e,<\/span><br \/><span style=\"color: #000000;\">sur justification, lorsque les frais r\u00e9ellement engag\u00e9s<\/span><br \/><span style=\"color: #000000;\">d\u00e9passent ce montant.<\/span><\/p>\n<p><span style=\"color: #000000;\">Aucun escompte n&rsquo;est accord\u00e9 en cas de paiement anticip\u00e9,<\/span><br \/><span style=\"color: #000000;\">sauf accord \u00e9crit particulier.<\/span><\/p>\n<h2><span style=\"color: #000000;\">Article 12 \u2013 D\u00e9lais de fabrication et livraison<\/span><\/h2>\n<p><span style=\"color: #000000;\">Les d\u00e9lais d\u00e9pendent notamment de la quantit\u00e9,<\/span><br \/><span style=\"color: #000000;\">du proc\u00e9d\u00e9 de fabrication, des mati\u00e8res<\/span><br \/><span style=\"color: #000000;\">et des caract\u00e9ristiques du projet.<\/span><\/p>\n<p><span style=\"color: #000000;\">Pour les particuliers, la date ou le d\u00e9lai de livraison<\/span><br \/><span style=\"color: #000000;\">est communiqu\u00e9 avant la conclusion de la commande.<\/span><\/p>\n<p><span style=\"color: #000000;\">Pour les professionnels, le d\u00e9lai ou la date<\/span><br \/><span style=\"color: #000000;\">convenue est pr\u00e9cis\u00e9 dans le devis d\u00e9finitif.<\/span><\/p>\n<p><span style=\"color: #000000;\">Lorsque les parties en conviennent, le d\u00e9lai<\/span><br \/><span style=\"color: #000000;\">de fabrication est calcul\u00e9 \u00e0 partir du r\u00e8glement<\/span><br \/><span style=\"color: #000000;\">et de la validation technique du projet.<\/span><\/p>\n<p><span style=\"color: #000000;\">En cas de difficult\u00e9 susceptible d&rsquo;affecter<\/span><br \/><span style=\"color: #000000;\">la livraison, DIPatch informe le client.<\/span><\/p>\n<p><span style=\"color: #000000;\">Les consommateurs conservent les droits pr\u00e9vus<\/span><br \/><span style=\"color: #000000;\">par le Code de la consommation en cas de retard<\/span><br \/><span style=\"color: #000000;\">ou de d\u00e9faut de livraison.<\/span><\/p>\n<h2><span style=\"color: #000000;\">Article 13 \u2013 Exp\u00e9dition et r\u00e9ception<\/span><\/h2>\n<p><span style=\"color: #000000;\">Les frais et modalit\u00e9s de livraison<\/span><br \/><span style=\"color: #000000;\">sont indiqu\u00e9s avant la validation de la commande<\/span><br \/><span style=\"color: #000000;\">ou dans le devis professionnel.<\/span><\/p>\n<p><span style=\"color: #000000;\">Pour les consommateurs, les risques sont transf\u00e9r\u00e9s<\/span><br \/><span style=\"color: #000000;\">lors de la prise de possession physique des biens<\/span><br \/><span style=\"color: #000000;\">par le client ou un tiers r\u00e9serve<\/span><br \/><span style=\"color: #000000;\">des droits et garanties l\u00e9gales applicables.<\/span><\/p>\n<h2><span style=\"color: #000000;\">Article 18 \u2013 Propri\u00e9t\u00e9 intellectuelle<\/span><\/h2>\n<p><span style=\"color: #000000;\">Les contenus, textes, photographies et cr\u00e9ations<\/span><br \/><span style=\"color: #000000;\">appartenant \u00e0 DIPatch restent prot\u00e9g\u00e9s par les droits<\/span><br \/><span style=\"color: #000000;\">de propri\u00e9t\u00e9 intellectuelle applicables.<\/span><\/p>\n<p><span style=\"color: #000000;\">Les logos, illustrations et fichiers transmis<\/span><br \/><span style=\"color: #000000;\">par les clients demeurent la propri\u00e9t\u00e9<\/span><br \/><span style=\"color: #000000;\">de leurs titulaires respectifs.<\/span><\/p>\n<p><span style=\"color: #000000;\">Le client autorise DIPatch \u00e0 reproduire,<\/span><br \/><span style=\"color: #000000;\">adapter techniquement et transmettre ces \u00e9l\u00e9ments<\/span><br \/><span style=\"color: #000000;\">aux partenaires de production uniquement<\/span><br \/><span style=\"color: #000000;\">dans la mesure n\u00e9cessaire \u00e0 l&rsquo;ex\u00e9cution<\/span><br \/><span style=\"color: #000000;\">de sa commande.<\/span><\/p>\n<p><span style=\"color: #000000;\">Aucun transfert de propri\u00e9t\u00e9 intellectuelle<\/span><br \/><span style=\"color: #000000;\">n&rsquo;est op\u00e9r\u00e9 du seul fait de la commande.<\/span><\/p>\n<p><span style=\"color: #000000;\">Les r\u00e9alisations comportant des n\u00e9cessaires \u00e0 la fabrication<\/span><br \/><span style=\"color: #000000;\">peuvent \u00eatre transmises aux partenaires concern\u00e9s,<\/span><br \/><span style=\"color: #000000;\">dans la
